End-of-waste status

The Waste and Contaminated Soil Law brings significant changes compared to previous legislation, mainly due to the incorporation of new concepts within the framework of the European Circular Economy Plan.

Ministerial Order on End-of-Waste Status

On June 22, 2023, Order TED/646/2023 was published in the Official State Gazette (BOE), establishing the criteria for determining when thermoplastic waste ceases to be waste, in accordance with the Waste and Contaminated Soil Act.

According to this Law, the criteria for end-of-waste status are:

  • The waste must be listed in Annex I (post-consumer and post-industrial plastic waste). It must comply with the limits for persistent organic pollutants (POPs) set out in EU Regulation 2019/1021.
  • The waste must have undergone some form of recovery process.
  • The plastic materials must have been tested according to the standards for recycled plastic products (UNE-EN 15342, UNE-EN 15344, UNE-EN 15345, UNE-EN 15346 or UNE-EN 15348). In addition, the non-plastic content must not exceed 2% and, depending on the application, the content of plastic other than that being manufactured must not exceed the limits set by the manufacturer.

In addition, Order TED/646/2023 requires the producer or importer to comply with the following obligations:

  • To issue a declaration of conformity with each shipment of recycled plastic material.
  • Have a management system in place to record the admission of thermoplastic waste, monitor waste recovery, and control the quality of the material obtained.
  • As a waste manager, the producer must keep a chronological record of the batch number, date of dispatch, customer identification, and quantity sold.
